On a private Commercial projects a notarized DELAWARE Statement Of Claim can be recorded by General/Prime contractors up to one hundred eighty (180) days or Subcontractors one hundred twenty (120) days after the last day providing equipment, labor, materials or services for a project. Record at the prothonotary of the superior court in the county where the project is located.

A recorded DELAWARE State Of Claim serves immediately as the complaint that initiates a lien foreclosure action against the lien property.

 

 On a private Existing Residential projects a notarized DELAWARE Statement Of Claim can be recorded by General/Prime contractors up to one hundred eighty (180) days or Subcontractors one hundred twenty (120) days after the last day providing equipment, labor, materials or services for a project.
