| On private Commercial projects TEXAS Property Code § 53.057 mandates that a TEXAS Notice Of Contractual Retainage must be sent by certified mail to the Owner following the initial delivery of equipment, labor, materials or services by a Subcontractor or but later than (thirty) 30 days from the completion of the improvement or the termination of a subcontract.
TEXAS Property Code § 53.056 mandates that Subcontractors who specially fabricate materials that are unsuitable for use on other projects must send a TEXAS Specialty Fabricated Materials Notice by certified mail to the Owner and other legal parties on a project (Customer, General Contractor, Lender). This helps protect a Subcontractor from the risk of cancellation of an order before delivery. TEXAS Property Code § 53.056 mandates that Subcontractors who don’t have a have a contract with the General/Prime Contractor must notify the General/Prime Contractor that they have a contract with a another Subcontractor (Sub of a Sub) with a balance due for supplied equipment, labor, materials or services by delivering by certified mail a TEXAS Second Month Notice. This notice must be sent by the 15th day of the second month when there is a balance due. This notice is not to be sent to the Owner. TEXAS Property Code § 53.056 mandates that Subcontractors who have a balance due on the third month after supplying equipment, labor, materials or services must send by certified mail to the General/Prime Contractor and Owner a TEXAS Commercial Notice Letter To Owner And General/Prime Contractor To Trap Funds.
